Home Loan Tax Benefits: Section 24(b) and 80C Explained

A home loan can lower your income tax. How much depends on your tax regime and whether you live in the home. Here are the rules in plain language.
First, pick your regime
India has two income tax regimes. The new regime is now the default and offers lower rates with fewer deductions. The old regime keeps deductions such as those below. For a self-occupied home, home loan benefits apply only under the old regime. Run the numbers both ways each year.
Section 24(b): interest
- Deduct up to ₹2 lakh a year of interest on a self-occupied home.
- Interest you pay during construction is claimed in five equal parts, starting the year construction completes. The ₹2 lakh cap still applies.
- Construction should complete within five years from the end of the year you took the loan, or the cap falls sharply.
Section 80C: principal, stamp duty and registration
- Principal repayments count toward the ₹1.5 lakh Section 80C limit.
- Stamp duty and registration also count, in the year you pay them.
- The ₹1.5 lakh limit is shared with PF, life insurance, ELSS and other items.
- If you sell the home within five years of possession, earlier 80C claims on principal are reversed.
Joint loans double the benefit
If you and your spouse are co-owners and co-borrowers, each can claim up to ₹2 lakh interest and ₹1.5 lakh under 80C on your own returns. This suits large villa loans. Structure ownership and the loan together from the start.
